Please read these terms carefully before using Fermently.

By downloading or using Fermently, you agree to these Terms of Use. If you do not agree, please do not use the app.

1. Acceptance of terms

These Terms of Use ("Terms") govern your use of the Fermently mobile application ("App") provided by Fermently ("we", "us", or "our"). By installing, accessing, or using the App, you confirm that you have read, understood, and agreed to these Terms.

2. License to use the app

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes in accordance with these Terms.

You may not:

  • Copy, modify, distribute, or create derivative works based on the App
  • Reverse engineer, decompile, or disassemble any part of the App
  • Use the App for any unlawful purpose or in violation of any applicable regulations
  • Transfer your license to any other person

3. In-app purchases

Fermently offers optional one-time in-app purchases that unlock premium features. All purchases are processed by Apple through the App Store. By completing a purchase, you agree to Apple's payment terms and policies.

One-time purchases are non-refundable except where required by applicable law or Apple's own refund policy. To request a refund, please use Apple's standard refund process via reportaproblem.apple.com.

You can restore your purchases at any time using the "Restore Purchases" option within the App.

4. User content

Any fermentation data, batch notes, readings, and other content you enter into the App ("User Content") remains yours. We do not claim ownership over your User Content.

You are solely responsible for the accuracy and completeness of your User Content. Fermently does not verify fermentation data or guarantee that the App's alerts and recommendations are accurate for every fermentation scenario.

5. Disclaimer of warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

Fermentation involves biological processes that can be unpredictable. Fermently's charts, alerts, and guides are informational tools only and do not constitute professional food safety or nutritional advice. Always use your own judgement when consuming fermented foods.

6. Limitation of liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, even if we have been advised of the possibility of such damages.

7. Intellectual property

All content in the App — including but not limited to text, graphics, logos, icons, and software — is owned by or licensed to us and is protected by applicable intellectual property laws. You may not reproduce or use any of this content without our prior written permission.

8. Termination

We may suspend or terminate your access to the App at any time if we believe you have violated these Terms. You may stop using the App at any time by deleting it from your device.

9. Changes to these terms

We reserve the right to modify these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. Your continued use of the App after such changes constitutes your acceptance of the revised Terms.

10. Governing law

These Terms are governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of France.
